what is Parliament Democracy when GE2004, GE2008 and GE2013 had been rigged by Elections Commission Malaysia. Yesterday, a warrant of arrest was issued to founder and editor of whistleblower site Sarawak Report, Clare Rewcastle-Brown for activities detrimental to parliamentary democracy

OPEN LETTER  - 9 points against EC and its performance and declaration of results

Important observations of the rigged Malaysian General Election 13 by Election Commission and its agents are as follows:-

1.       The solid evidence of the two publication of Gazette on GE13 on 22^nd May, and 31 May, 2013 which itself confirmed the improper management of the GE and the results thereof as declared after counting on the polling day of 5^th May, 2013.  The final results were manipulated as the preliminary results at the Polling centres were not published by EC.

2.       The details of the results in the Gazette did not include this item – the number of ballot papers in the ballot boxes.  This was in Gazette of previous General Elections. Why this was omitted was obvious.

3.       The Gazette of 22^nd May, 2013 even has a loser declared as winner further confirmed the recalcitrant EC.

4.       The extremely record high voters turnout indicates manipulation of the ballot papers and ballot boxes hence fixing of the election results when the first past the post system –FPPS allowed the minority party with 47% of the votes form the Federal Government as against the opposition Pakatan Rakyat with 51%.

5.       There are many other issues already raised in the mass media including the cyberspace cannot be ignored any more hence the return under Article 118A of the Federal Constitution on the night of the counting was defective to allow the King or Agong to swear in the ‘re-elected’ Prime Minister.  The evidence against the EC and its declaration of results is conclusive.

6.       This Return as defective is confirmed by the Gazette of 22^nd May, 2013 and must be challenged and complete scrutiny of all the records of the EC and its agents without the process of any petition of the High Courts as the Judiciary lacks the expertise to deal with the nitty gritty of the whole election process which has been manipulation for decades.  The Police is also ‘hand tight’ to do proper investigation on the challenge of the General Elections as I had experienced in GE2004 and GE2008.

7.       I have seen the copy of the official publication by EC on GE2004 and the auditors of EC did not mention the massive discrepancies of the Ballot Papers issued for the Parliament and the state seats under each Parliament seat.  I had presented these discrepancies in OPEN letter and all the authorities concerned including Judiciary were happy with this electoral fraud.

8.       I call upon all concerned citizens and voters of Malaysia to demand that EC handover all documents NOW in its custody before they are destroyed and sometimes before the 6 months of legal process was up. Without complete scrutiny, the appointed Governments – Federal and State remain illegitimate.

9.       In the intervening time before a repeat of GE13, the Interim Good Governance Government (IGGG) must be installed immediately with parties excluding BN/UMNO and PR to see that justice be served so that the next GE can be true, clean, fair and free in all aspects.
